Terms of Delivery Handmade Tiles

1. General Provisions
1.1 These terms of delivery apply to all quotations, orders, and deliveries of handmade tiles by De Tegel BV, located at Rudonk 2B, 4824 AJ in Breda, the Netherlands.
1.2 Deviations from these terms are only valid if agreed upon in writing.
1.3 By placing an order, the customer agrees to these terms.

2. Product Information
2.1 Our tiles are handmade and may exhibit variations in color, size, and texture. This is a characteristic of the artisanal production process and does not constitute grounds for a claim.
2.2 It is the customer’s responsibility to ensure the tiles are suitable for their intended use.
2.3 Samples serve as an indication; the delivered products may differ from them. This does not entitle the customer to file a claim.

3. Quotations and Orders
3.1 Quotations are non-binding and valid for a specific period, as stated in the quotation.
3.2 An agreement is established once the customer places an order and we confirm it.
3.3 Changes to an order are only possible after consultation and may result in price and delivery time adjustments.
3.4 Cancellation of custom-made orders is only possible before production begins and may incur cancellation fees.

4. Prices and Payment
4.1 All prices include VAT and transport costs unless stated otherwise.
4.2 Payment must be made according to the agreed terms, usually in advance or upon delivery.
4.3 In case of late payment, we reserve the right to suspend or cancel the delivery.
4.4 Any collection costs due to non-payment will be borne by the customer.

5. Delivery and Transport
5.1 Delivery times are indicative and may vary depending on production scheduling.
5.2 Delivery takes place at the agreed address. The risk of damage or loss transfers to the customer upon receipt of the tiles.
5.3 If delivery is carried out by transporters, the customer must inspect the goods immediately upon receipt. Any damage must be reported within 24 hours.

6. Returns and Complaints
6.1 Due to the handmade nature of our tiles, returns are only possible in the case of demonstrable manufacturing defects.
6.2 Complaints must be submitted in writing within  5 days of delivery, accompanied by clear photos of the issue.
6.3 If a complaint is justified, we will, at our discretion, proceed with replacement or another suitable solution.
6.4 Returns must be made in original, undamaged full boxes. Boxes that do not meet these requirements will not be considered for reimbursement.
6.5 Return shipping costs are the customer’s account.
6.6 Returns must be reported to us by email at least 5 working days in advance.

7. Liability and Warranty
7.1 We guarantee that the tiles meet the specified quality and standards.
7.2 Our liability is limited to the invoice amount of the relevant order. Indirect damages will not be compensated.
7.3 Tiles that have already been processed cannot be claimed.
7.4 We are not liable for damage caused by improper use, incorrect installation, or inadequate maintenance of the tiles.
7.5 Force majeure (such as natural disasters, strikes, or supply chain issues) releases us from delivery obligations.

8. Applicable Law and Disputes
8.1 All agreements and transactions are subject to Dutch law.
8.2 Disputes will first be resolved through mutual consultation. If this is not successful, the competent court in the Netherlands will be engaged.
